The last two years have not been gentle to anyone who builds, buys or fields surveillance systems. What started as better lenses and denser camera grids has turned into a distributed sensor fabric driven by machine learning, biometric matching and commodified intrusion tools. The International Bar Association’s recent work on AI governance and the legal profession is an important prompt for security practitioners to stop treating policy and compliance as afterthoughts and to bake them into product design and procurement cycles.

From an engineering perspective the evolution is straightforward to describe. Surveillance systems migrated from passive recording to analytic-first designs. Video systems now ship with onboard or cloud analytics that triage footage in real time. Face comparison, object detection, behavior heuristics and automated scrubbing make previously intractable datasets actionable. That capability is useful. It is also dangerous when accuracy, provenance and use constraints are not engineered and enforced alongside the capability. The institutional response is catching up. The European Artificial Intelligence Act sets clear limits on the most intrusive uses of AI for remote biometric identification and mandates risk-based controls and oversight. Security projects that ignore those rules will rapidly become legacy risks rather than competitive assets.

These are not abstract problems. In 2024 we saw operational rollouts of facial recognition at scale for public events and city deployments, where police and public authorities consolidated camera feeds with automated matching to watchlists. The Delhi Police procurement and deployment of hundreds of AI-enabled cameras in mid 2024 illustrates how fast agencies can move from pilot to operational use. For private sector suppliers and integrators that work with public agencies, that pace demands the processes to match: demonstrable human review, bias testing, data minimisation and clear retention policies.

At the same time, the spyware and mercenary surveillance market keeps expanding the threat model. Independent research and rights groups documented cases in 2024 where sophisticated mobile spyware was used against journalists and civil society, underscoring that offensive surveillance tools are an active, cross-border market problem. Practitioners need to assume hostile actors will attempt to leverage both networked sensors and covert device compromise when designing defenses and audit programs.

So what should a practical security inventor, integrator or buyer do differently tomorrow? Start with these concrete steps.

1) Map the actor model and failure modes. For every system produce a short, adversary-driven threat matrix that covers misuse, data exfiltration, algorithmic failure and regulatory noncompliance. This is not a bureaucratic exercise. It directly informs how you lock down telemetry, separate duties and instrument forensics.

2) Adopt a risk framework early. The NIST AI Risk Management Framework is a useful operational starting point for AI-enabled surveillance because it translates trustworthiness goals into governance and lifecycle activities you can implement. Use it to set testing requirements, define acceptable performance boundaries and decide when a human must intervene.

3) Build human-in-the-loop controls and audit trails. Wherever automated matching can affect liberty, movement or reputation, enforce a documented human review step, immutable logs and retention limits. Logs must be tamper-evident and accessible to oversight bodies. Operationally, this changes UI design and data pipelines, but it also saves organizations from catastrophic legal and reputational failure.

4) Operationalise end-use and export checks. Many surveillance components are dual-use. Vendors and buyers need contractual end-use clauses and technical gating. If your stack can be repurposed for coercive state surveillance or transnational repression, include kill-switches, binding audits and pre-deployment approvals.

5) Validate on representative data and publish tests. Performance claims are useless if they are not validated against diverse, realistic datasets. Publish transparency reports for sensitive deployments and permit third-party audits where appropriate. This is increasingly a procurement requirement in Western jurisdictions and a best practice elsewhere.

6) Design for minimal data collection. The easiest way to reduce risk is to collect less data. Implement edge processing to extract only action-relevant metadata, store biometric templates in hashed or tokenised forms when possible and truncate retention aggressively.

7) Prepare governance artifacts for procurement and field teams. Deliverable items should include a short privacy impact assessment, an algorithmic impact statement, a list of training data sources, a conformity checklist against relevant laws and an incident playbook.

The IBA’s recent report and programmatic work remind lawyers and bar associations that they cannot be passive observers in the AI transition. For technologists this is an invitation to de-risk adoption by speaking the legal language and building the artifacts that regulators and counsel will want to see. The IBA framing matters because it accelerates the trend we are already seeing: legal actors, judges and regulators will be in the room where technical decisions are made.

Finally, remember that surveillance capability is not a single product. It is an ecosystem of sensors, analytics, data brokers, and operational policies. Success in the market will come to teams who engineer the whole stack, not just the model. If you are building prototypes, start with threat-informed design, build oversight hooks from day one and make ethical constraints part of the product spec. That approach keeps your tech useful, defensible and adoptable in a world where legal and human rights frameworks are catching up fast. The trade-offs are real, but they are manageable if you design for them.
